  • A Protection from Stalking, Sexual Assault, or Human Trafficking Order (PFS) is a court order to protect you from someone who stalked, sexually assaulted or trafficked you. It is available even if you have no relationship with that person. It is also free.

    You can petition for yourself. Or, you can petition for a child under the age of 18, when you are their parent, court appointed custodian/guardian, or an adult who lives with the child.

    You are the “plaintiff.’ The person you are seeking protection from is known as the “defendant,” or the adverse party.

    The adverse party is the person you are seeking protection from. Law enforcement will need specific information about the adverse party to find them and “serve” them with a copy of the petition.  “Serve” just means give the documents in person.

      When the adverse party is less than 18 years old, the court needs more information.

      A guardian is a person appointed by the court to make legal decisions affecting the adverse party's personal health, safety and welfare.

  • What happened?

    The court wants to understand why you need the protective order. 
  • "Stalking” is intentional harassment that puts you in reasonable fear for your safety. Harassment includes repeated behaviors that seriously alarm, annoy, torment or terrorize you. For example: harassing emails, texts, phone calls, letters, acts of vandalism, threats communicated through other people, and more. The use of a drone near your home, occupied car, or other private area, to torment or terrorize you also qualifies as stalking.

    You must describe two or more separate incidents to qualify for a protection order.

  • "Sexual assault” is an unwanted sexual act or an attempted sexual act against you by force, threat of force, duress, or when you are incapable of giving consent. 

    “Sexual Assault” is:

    • A sexual act without your consent
    • An attempted sexual act, involving force, threats of force, or duress (pressure or coercion) or
    • An attempted sexual act, when you were incapable of giving consent.

    “Consent” is when you give permission for the specific sexual act at the time it takes place.  Consent can be withdrawn at any time.

    You are “Incapable of giving consent” if you are under 16, unconscious, asleep, intoxicated, physically helpless, or unable to communicate.

  • "Human Trafficking” is:

    • Involuntary forced labor
    • Getting labor or sex from a person, through the use of force, fraud, or coercion
    • Selling sexual relations

    “Human trafficking” means the person you are seeking protection from used force, fraud or coercion to get labor or commercial sex.  Commercial sex is when anything of value is given or received in exchange for sex.

    Coercion includes:

    • Causing or threatening physical injury
    • Restraining or threatening to restrain any person
    • Abusing or threatening to abuse the law or legal system
    • Threatening to withhold food, lodging, clothing or
    • Taking or hiding government identification
    • Kidnapping
  • “Human trafficking” means the adverse party knowingly gave something of value for forced labor or sexual contact with the child.   As long as the adverse party: recruited, harbored, transported, provided, obtained, or hired the child, you do not need to show there was force, threat or coercion. 

    Government attorneys can also file a petition for children under 18. Like the county or district attorney or the Attorney General.

    Relief is what you are asking the court to order. The court may grant a temporary order. In about 21 days, you will go for a hearing. The court can then make the protection order final.
